AB150,2234,1615 (a) "Lender" means a public depository under ch. 34 that is approved by the
16department for participation in the program under this section.
AB150,2234,2117 (b) "Passive real estate project" means the purchase or ownership of real estate
18for the purpose of deriving income from speculation, trade or rental of the property,
19except that "passive real estate project" does not include the purchase or ownership
20of that portion of real estate that is used for operation of the business of the real estate
21owner.
AB150,2234,2422 (c) "Small business" means a business entity, including a parent corporation or
23any subsidiary or affiliated corporation, that employs fewer than 51 full-time
24employes or that has gross annual sales of less than $5,000,000.

1(2) The department shall administer a loan incentive program, to be called the
2capital access program. Under the program, the borrower of an eligible loan that is
3made by a participating lender shall pay a fee to the lender for enrolling the loan in
4the program. For each such enrolled loan, the lender shall contribute an amount that
5is equal to the fee paid by the borrower of the loan and the department shall pay a
6financial incentive to the lender that equals the sum of the fee paid by the borrower
7of the loan and the contribution made by the lender. All financial incentives paid by
8the department for loans enrolled in the program by a lender shall be deposited in
9an interest-bearing reserve account that is owned and controlled by the department
10but maintained by the lender. All moneys contributed for enrolled loans by a lender
11and the fees paid by the borrowers of all of the loans enrolled in the program by that
12lender shall be deposited in another interest-bearing reserve account that is owned
13and controlled by the department but maintained by the lender. Except as provided
14in sub. (4), moneys in the reserve accounts, including accrued interest, may be used
15by the department only to compensate the lender for losses that it incurs if a borrower
16of an enrolled loan defaults on the loan.
AB150,2235,20 17(3) A loan may be enrolled in the program only if it is related to the start-up
18or expansion of a small business and will likely result in the creation or retention of
19jobs within the state. A loan may not be enrolled in the program if it is made to
20finance any of the following:

AB150,2235,2222 (b) A housing project.
AB150,2235,2323 (c) A passive real estate project.
AB150,2235,2424 (d) Any other activities or projects determined by the department.

1(4) If a participating lender wishes to withdraw from the program, the
2department shall close out the reserve accounts maintained by the lender and
3deposit the moneys, including accrued interest, in the appropriation account under
4s. 20.143 (1) (kq).
AB150,2236,6 5(5) The department shall promulgate rules that set forth criteria for all of the
6following:
AB150,2236,87 (a) Determining the maximum amount that may be loaned under the program
8to a single borrower.
AB150,2236,109 (b) Determining the amount of the fee that the borrower of an enrolled loan
10must pay.
AB150,2236,1211 (c) Any other criteria that the department determines is necessary for operation
12of the capital access program.
AB150,2236,15 13(6) As part of the report required under s. 15.04 (1) (d), the department shall
14include a report detailing the operation of the capital access program and assessing
15the effectiveness of the program in promoting economic development.

22had gross annual sales of $25,000,000 or less in the calendar year preceding the year
23in which it applies for a reimbursement under this section.

25by the U.S. department of commerce and that has prearranged meetings between

1new-to-market or new-to-export eligible businesses and prospective foreign
2representatives and distributors.
AB150,2237,53 (c) "Trade show" means a trade event held in a country other than the United
4States that brings prospective foreign buyers to a central location and that is
5certified or coordinated by the U.S. department of commerce or the department.
AB150,2237,8 6(2) Subject to sub. (5), the department may make reimbursements totaling no
7more than $100,000 in a fiscal year from the appropriations under s. 20.143 (1) (c)
8and (ie) to eligible businesses for any of the following:
AB150,2237,109 (a) Fees for participation in a trade show or matchmaker trade delegation
10event.
AB150,2237,1211 (b) Costs associated with shipping displays, sample products, catalogs or
12advertising material to a trade show or matchmaker trade delegation event.
AB150,2237,1413 (c) Costs incurred at a trade show or matchmaker trade delegation event for
14utilities, booth construction or necessary modifications or repairs.
AB150,2237,1715 (d) Costs associated with foreign language translation of brochures or product
16information or with the use of translation services at a trade show or matchmaker
17trade delegation event.
AB150,2237,19 18(3) An eligible business seeking reimbursement under this section shall submit
19to the department an application containing all of the following:
AB150,2237,2220 (a) An export development plan and a description of how the activities for which
21reimbursement is sought will benefit the applicant's ability to export its product or
22service.
AB150,2237,2423 (b) An itemized budget for expenses expected to be incurred for all of the
24activities for which reimbursement is sought.
AB150,2237,2525 (c) A description of the proposed use of the reimbursement.

1(d) Assurance that at least 50% of the manufactured value of the product or of
2the performance value of the service will be produced in this state.
AB150,2238,4 3(4) (a) The department may approve an eligible business for reimbursement
4after considering all of the following:
AB150,2238,65 1. The extent to which the business' export development plan demonstrates the
6potential of the product or service to be exported in a particular foreign market.
AB150,2238,87 2. The extent to which the business' proposed reimbursable activities relate to
8the potential success of the product or service to be exported.
AB150,2238,109 (b) The department shall give priority for reimbursements under this section
10to eligible businesses participating in the department's export mentoring program.
AB150,2238,11 11(5) The department may not do any of the following:
AB150,2238,1212 (a) Reimburse an eligible business more than $5,000 in a 12-month period.
AB150,2238,1413 (b) Reimburse an eligible business more than $5,000 for participation in a trade
14show or matchmaker trade delegation event.
AB150,2238,1715 (c) Reimburse an eligible business for participating more than one time in the
16same trade show or matchmaker trade delegation event held at different times or in
17different locations.
AB150,2238,1918 (d) Reimburse an eligible business more than $15,000 over the life of the
19program.
AB150,2238,23 20(6) An eligible business that is approved for a reimbursement under sub. (4)
21shall provide to the department, within 90 days after the trade show or matchmaker
22trade delegation event for which the reimbursement is sought, documentation
23detailing the costs for which the reimbursement is sought.
